State park fees.

A BILL

 

for

 

 1  AN ACT relating to state parks; modifying specified park
 2  user permit fees; extending state park annual overnight
 3  camping permit to nonresidents; and providing for an
 4  effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 36-4-121(a)(ii), (iii), (vi), (viii),
 9  (b) and (c) is amended to read:

10 

11         36-4-121.  Permits to use state parks, recreation
12  areas and historic sites.

13 

14         (a)  The department of state parks and cultural
15  resources shall offer for sale permits that allow use of
16  the state parks, recreation areas, archeological sites and

 1  historic sites. Daily use permits shall be required at
 2  Glendo, Guernsey, Curt Gowdy, Edness Kimball Wilkins,
 3  Buffalo Bill, Boysen, Seminoe and Keyhole state parks and
 4  Fort Bridger, South Pass City, Trail End, Fort Fetterman
 5  and Fort Phil Kearney state historic sites, and Hawk
 6  Springs state recreation area. The department may establish
 7  voluntary pay stations at Bear River and Hot Springs state
 8  parks to allow users of those parks to make voluntary
 9  contributions for the use of the state parks. Persons who
10  enter or use Bear River or Hot Springs state park without
11  paying daily use fees shall not be subject to the penalties
12  provided for in subsection (j) of this section. Overnight
13  camping permits shall be required at Boysen, Buffalo Bill,
14  Curt Gowdy, Glendo, Guernsey, Keyhole, Seminoe and Sinks
15  Canyon state parks, Connor Battlefield state historic site,
16  Medicine Lodge state archeological site and Hawk Springs
17  state recreation area by the department during the entire
18  calendar year. The cost of the permits authorized under
19  this section shall be:

21              (ii)  Thirty dollars ($30.00) per calendar year
22  for an annual resident overnight camping permit, to and
23  sixty dollars ($60.00) per calendar year for an annual
24  nonresident overnight camping permit, authorizing overnight

 1  camping at designated state parks, historic sites,
 2  archeological sites and recreation areas to be issued to
 3  Wyoming residents only, valid for the holder and occupants
 4  of the holder's vehicle;

 5 

 6              (iii)  Except as provided under paragraph (a)(v)
 7  of this section, two dollars ($2.00) for residents and five
 8  dollars ($5.00) four dollars ($4.00) for nonresidents for
 9  the daily use fee for designated state parks, archeological
10  sites and recreation areas, valid for the date of purchase
11  for the holder and occupants of the holder's vehicle and
12  for the holder entering the park or area by bicycle,
13  horseback or on foot;

15              (vi)  Four dollars ($4.00) per night for
16  residents and nine dollars ($9.00) eight dollars ($8.00)
17  for nonresidents for overnight camping at any designated
18  state park, historic site, archeological site and
19  recreation area valid for the date of purchase and the
20  following day until 3:00 p.m. for the holder and occupants
21  of the holder's vehicle;

 1              (viii)  Five dollars ($5.00) for each additional
 2  vehicle annual resident or nonresident overnight camping
 3  permit issued under subsection (b) of this section;

 4 

 5         (b)  Any holder of an annual bucking horse entrance
 6  permit or an annual resident or nonresident overnight
 7  camping permit may obtain additional vehicle annual bucking
 8  horse entrance permits or additional vehicle annual
 9  resident overnight camping permits from the department or
10  any selling agent of the department upon payment of the fee
11  prescribed under paragraph (a)(vii) or (viii) of this
12  section, as applicable, and upon submission of proof
13  satisfactory to the department that an original annual
14  permit was purchased and that the additional vehicle is
15  registered in the same name as the vehicle for which the
16  original annual permit is obtained, or that the additional
17  vehicle is operated by the person who purchased the
18  original annual permit or a member of his family under duly
19  granted authority from his employer. The director shall
20  determine the validity of the authority of an applicant to
21  operate an employer-owned vehicle prior to issuance of an
22  additional vehicle permit for that vehicle under this
23  section. Any vehicle in tow by another vehicle owned by the
24  same person shall be considered a single vehicle for

 1  purposes of this section and only a single annual bucking
 2  horse daily use permit shall be required for entrance at
 3  state parks and a single annual resident overnight camping
 4  permit shall be required for overnight camping at state
 5  parks.

 6 

 7         (c)  If an annual bucking horse daily use permit or an
 8  annual resident or nonresident overnight camping permit is
 9  lost, mutilated or destroyed, the holder of the permit may
10  obtain a duplicate annual permit from the department or any
11  selling agent of the department upon filing an affidavit
12  showing the loss, mutilation or destruction of the original
13  permit and upon payment of the fee imposed under paragraph
14  (a)(ix) or (x) of this section, as applicable.

16         Section 2.  This act is effective January 1, 2002.
