Injuring law enforcement and emergency animals-felony.

A BILL

 

for

 

 1  AN ACT relating to crimes and offenses; creating the crime
 2  of injuring or killing specified animals used by law
 3  enforcement and emergency agencies; providing elements of
 4  the crime; providing penalties; providing definitions; and
 5  providing for an effective date.

 6 

 7  Be It Enacted by the Legislature of the State of Wyoming:

 8 

 9         Section 1.  W.S. 6-5-211 is created to read:

10 

11         6-5-211.  Injuring or killing a police dog, fire dog,
12  search and rescue dog or police horse prohibited;
13  penalties.

14 

15         (a)  Any person who knowingly, willfully and without
16  lawful cause or justification inflicts serious bodily harm,

 1  permanent disability or death upon a police dog, fire dog,
 2  search and rescue dog or police horse is guilty of a felony
 3  punishable by imprisonment for not more than three (3)
 4  years.

 5 

 6         (b)  As used in this section:

 7 

 8              (i)  "Police dog" means any dog that is owned, or
 9  the service of which is employed, by a law enforcement
10  agency for the principal purpose of aiding in the detection
11  of criminal activity, enforcement of laws or apprehension
12  of offenders;

13 

14              (ii)  "Police horse" means any horse that is
15  owned, or the service of which is employed, by a law
16  enforcement agency for the principal purpose of aiding in
17  the detection of criminal activity, enforcement of laws or
18  apprehension of offenders;

19 

20              (iii)  "Fire dog" means any dog that is owned, or
21  the service of which is employed, by a fire department, a
22  special fire district or the state fire marshal for the
23  principal purpose of aiding in the detection of flammable
24  materials or the investigation of fires;

 2              (iv)  "Search and rescue dog" means any search
 3  and rescue dog that is owned, or the service of which is
 4  utilized, by a fire department, a law enforcement agency, a
 5  special fire district or the state fire marshal for the
 6  principal purpose of aiding in the detection of missing
 7  persons, including persons who are lost, who are trapped
 8  under debris as a result of a natural, manmade or
 9  technological disaster or who are drowning victims.

11         Section 2.  This act is effective July 1, 2001.
