Local government finances.

A BILL

 

for

 

 1  AN ACT relating to local government revenues and
 2  expenditures; creating a select committee to review local
 3  government finances; providing for operation of the
 4  committee; requiring a report; providing an appropriation;
 5  delaying the effective date of the de-earmarking of certain
 6  state revenues; limiting distribution of certain funds; and
 7  providing for an effective date.

 9  Be It Enacted by the Legislature of the State of Wyoming:

10 

11         Section 1.

12 

13         (a)  There is created a select committee on local
14  government expenditures and revenues. The committee shall
15  assess local government expenditures and revenues and shall
16  use available studies, reports and budget documents to the
17  extent practicable. The committee shall make

 1  recommendations, including recommendations for legislation
 2  modifying local government revenue and expenditure
 3  provisions, to the legislature by September 30, 2001. The
 4  joint revenue interim committee shall review the
 5  recommendations and develop legislation for introduction in
 6  the 2002 budget session as the revenue committee determines
 7  appropriate.

 9         (b)  The select committee on local government
10  expenditures and revenues shall consist of:

11 

12              (i)  Three (3) members appointed by the president
13  of the senate, one (1) of whom shall be a member of the
14  minority party; and

15 

16              (ii)  Four (4) members appointed by the speaker
17  of the house, one (1) of whom shall be a member of the
18  minority party.

19 

20         (c)  The select committee shall be staffed by the
21  legislative service office. All executive branch agencies
22  and local government entities shall provide assistance to
23  the committee upon request.

 1         (d)  The committee created by this section shall
 2  terminate October 1, 2001.

 3 

 4         Section 2.  There is appropriated from the general
 5  fund twenty thousand dollars ($20,000.00) to the
 6  legislative service office for purposes of this act.

 7 

 8         Section 3.  2000 Wyoming Session Laws, Chapter 97,
 9  Section 6(b) is amended to read:

11         Section 6.

13         (b)  The balance of this act is effective
14  July 1, 2001 2002.

15 

16         Section 4.

17 

18         (a)  Notwithstanding any other provision of law,
19  mineral severance tax distributions under Wyoming statutes,
20  title 39, article 14, shall not exceed the following
21  amounts for each of the fiscal years beginning July 1, 2000
22  and ending June 30, 2001 and beginning July 1, 2001 and
23  ending June 30, 2002:

 1              (i)  To water development account I under W.S.
 2  41-2-124(a)(i), twenty-six million four hundred thousand
 3  dollars ($26,400,000.00);

 4 

 5              (ii)  To water development account II under W.S.
 6  41-2-124(a)(ii), five million two hundred fifty thousand
 7  dollars ($5,250,000.00);

 8 

 9              (iii)  To the highway fund, eleven million seven
10  hundred thousand dollars ($11,700,000.00). Any required
11  distribution to the state park road account pursuant to
12  W.S. 39-14-211(d)(vii)(B), shall be included in calculating
13  the maximum distribution pursuant to this paragraph;

15              (iv)  To counties, for distributions pursuant to
16  W.S. 39-14-211(d)(ii), seven million four hundred thousand
17  dollars ($7,400,000.00);

18 

19              (v)  To counties, for distributions pursuant to
20  W.S. 39-14-111(f)(iii), two million fifty thousand dollars
21  ($2,050,000.00);

22 

23              (vi)  To the road construction funds of the
24  various counties for distributions pursuant to W.S.

 1  39-14-111(f)(ii), six million one hundred fifty thousand
 2  dollars ($6,150,000.00);

 3 

 4              (vii)  To cities and towns, twenty-three million
 5  four hundred thousand dollars ($23,400,000.00);

 6 

 7              (viii)  To the capital construction account, five
 8  million seven hundred thousand dollars ($5,700,000.00).

 9 

10         (b)  Funds in excess of any of the maximum amounts
11  specified in subsection (a) of this section shall be
12  distributed to the local government capital construction
13  account under W.S. 9-4-604(a). Funds distributed under W.S.
14  39-14-211(e) shall be adjusted accordingly. To the extent
15  that funds distributed prior to the effective date of this
16  section exceed the maximum amounts specified, the state
17  treasurer shall reduce from distributions made for the
18  fiscal year beginning July 1, 2001 and ending June 30,
19  2002, an amount equal to the excess amount.

 1         Section 5.  This act is effective immediately upon
 2  completion of all acts necessary for a bill to become law
 3  as provided by Article 4, Section 8 of the Wyoming
 4  Constitution.
