School board trustee residence areas.

A BILL

 

for

 

 1  AN ACT relating to school districts; modifying the
 2  procedure for election of district board members by trustee
 3  residence area; and providing for an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 21-3-111(b)(ii) is amended to read:

 8 

 9         21-3-111.  Powers of boards of trustees.

10 

11         (b)  Not later than January 1, 1998, the board of
12  trustees of each school district that has established
13  trustee residence areas before that date shall:

15              (ii)  Establish by resolution a structure for
16  electing members to the board through trustee residence

 1  areas with not less than two (2) members of the board
 2  elected at-large from the entire district. If the board
 3  establishes trustee residence areas under this paragraph,
 4  one (1) or more members shall be elected from each area.
 5  The boundaries of the trustee residence areas shall be
 6  established so that the total deviation in the population
 7  between the areas with the greatest and least population
 8  shall not, to the extent practicable, exceed ten percent
 9  (10%). Data from the most recent federal census shall be
10  used in determining population within an area for the
11  purpose of implementing this paragraph. The resolution
12  shall include a process for implementing this change so
13  that all elected trustees may serve their full term but
14  that any vacancy shall be filled so as to implement the
15  change as soon as practicable.
In the event that there
16  exists within a school district a city or town with a
17  junior or senior high school and the population of the
18  residents living within the area being served by the junior
19  or senior high school is insufficient to ensure that at
20  least one (1) member of the board of trustees will be
21  elected from such area, the school board may deviate from
22  the ten percent (10%) requirement for no more than one (1)
23  trustee position by creating a trustee district which shall

 1  ensure that a trustee is elected from the area served by
 2  the junior or senior high school.

 3 

 4         Section 2.  This act is effective July 1, 2001.
