Theft detection shielding devices.

A BILL
for
1 AN ACT relating to theft
detection shielding devices;
2
creating crimes relating to possession and use of theft
3
detection shielding devices as specified; providing
4
penalties as specified; and providing for an effective
5
date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section 1. W.S. 6-3-411 is created to read:
10
11 6-3-411. Unlawful use of theft
detection shielding
12 devices; penalty.
13
14 (a) A person
commits unlawful use of a theft
15 detection shielding device when he
knowingly manufacturers,
16 sells, offers for sale or
distributes any laminated or

1 coated
bag or device peculiar to shielding and intended to
2
shield merchandise from detection by an electronic or
3
magnetic theft alarm sensor.

5 (b) A person
commits unlawful possession of a theft
6
detection shielding device when he knowingly possesses any
7
laminated or coated bag or device peculiar to and designed
8
for shielding and intended to shield merchandise from
9
detection by an electronic or magnetic theft alarm sensor,
10 with the intent to commit theft.

12 (c) A person
commits unlawful possession of a theft
13 detection device remover when he
knowingly possesses any
14 tool or device designed to allow the
removal of any theft
15 detection device from any
merchandise without the
16 permission of the merchant or person
owning or holding the
17 merchandise, with the intent to
commit theft.

19 (d) A person
commits the offense of unlawful removal
20 of a theft detection device when he
intentionally removes
21 the device from a product prior to
purchase without the
22 permission of the merchant or person
owning or holding the
23 merchandise.

1 (e) A person
who commits any of the offenses
2
specified under subsections (a) through (d) of this section
3
shall be guilty of a misdemeanor for a first offense,
4
punishable by imprisonment for not more than six (6)
5
months, a fine of not more than seven hundred fifty dollars
6
($750.00), or both.

8 (f) Any person convicted under this section, or if
9
the person has previously been convicted of a violation of
10 this section or any substantially
conforming statute in
11 another state or local jurisdiction
within the five (5)
12 years preceding the date of the
offense upon which the
13 conviction is based or the date of
the conviction at issue,
14 shall be guilty of a felony
punishable by imprisonment for
15 not more than five (5) years, a fine
of not more than five
16 thousand dollars ($5,000.00), or
both.

18 Section 2. This act is effective July 1, 2001.
