State lands-lease terms and purposes.

A BILL

 

for

 

 1  AN ACT relating to state lands; modifying the term and
 2  purposes of state land leases; requiring rulemaking to
 3  establish rental fees for lands leased for affordable
 4  housing purposes; and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 36-5-114(a) and (c) is amended to
 9  read:

10 

11         36-5-114.  Leasing for industrial, commercial,
12  recreational, residential and affordable housing purposes;
13  authority; rental fees.

14 

15         (a)  The board of land commissioners may lease, for a
16  term of not more than twenty-five (25) years, with a

 1  preferential right to renew, for successive like periods,
 2  state lands for industrial, commercial, and recreational,
 3  residential and affordable housing purposes. The board
 4  shall by rule and regulation establish criteria for
 5  determining affordable housing under this section.

 6 

 7         (c)  Except as otherwise provided in this subsection,
 8  t
he board shall fix a rental value on the basis of a
 9  definite amount per acre based upon not less than fair
10  market value of each use of the land. If the land to be
11  leased is for affordable housing purposes, the board shall
12  by rule and regulation establish criteria for determining
13  the rental value of state lands leased under this section.
14  If the land to be leased under this subsection was
15  originally acquired by the state for the benefit of the
16  common school permanent land fund, and is to be used by a
17  Wyoming school district for the construction and
18  maintenance of school buildings and facilities, the board
19  may assess an annual rental fee of one hundred dollars
20  ($100.00) per acre or not less than fair market value,
21  whichever is less.

 1         Section 2.  This act is effective immediately upon
 2  completion of all acts necessary for a bill to become law
 3  as provided by Article 4, Section 8 of the Wyoming
 4  Constitution.
