A BILL

 

for

 

 1  AN ACT relating to motor vehicles; modifying elements of
 2  the offense of eluding a police officer and providing
 3  penalties; and providing for an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 31-5-225 is amended to read:

 8 

 9         31-5-225.  Fleeing or attempting to elude police
10  officers; penalty.

11 

12         (a)  Any driver of a motor vehicle who willfully fails
13  or refuses to bring his vehicle to a stop in compliance
14  with a signal by a police officer, or who otherwise flees
15  or attempts to elude a pursuing marked police vehicle, when

 1  given visual or audible is guilty of eluding a police
 2  officer, provided:

 3 

 4              (i)  The signal to bring the vehicle to a stop,
 5  is guilty of a misdemeanor. The signal given by the police
 6  officer may be by hand, voice, emergency light or and
 7  siren;.

 8 

 9              (ii)  The officer giving the signal shall be is
10  in uniform, prominently displaying his badge of office;,
11  and his

12 

13              (iii)  The officer's vehicle shall be is
14  appropriately marked showing it to be an official police
15  vehicle.

17         (b)  Every person convicted of fleeing or attempting
18  to elude Except as provided in subsection (c) of this
19  section, eluding a police officer shall be punished is a
20  misdemeanor punishable by a fine of not more than seven
21  hundred fifty dollars ($750.00), or by imprisonment for not
22  more than ninety (90) days six (6) months, or both.

 1         (c)  Eluding a police officer is punishable as
 2  provided in this subsection if the person drives a motor
 3  vehicle in willful and wanton disregard for the safety of
 4  persons or property and the act results in property damage
 5  in excess of one thousand dollars ($1,000.00) or injury to
 6  any person. A person convicted under this subsection shall
 7  be punished by imprisonment for not less than seven (7)
 8  days nor more than six (6) months and shall not be eligible
 9  for probation or suspension of sentence or release on any
10  other basis until he has served at least seven (7) days in
11  jail. In addition, the person shall be fined not less than
12  two hundred dollars ($200.00) nor more than seven hundred
13  fifty dollars ($750.00).

15         Section 2.  This act is effective July 1, 2001.
