                (b) The tourism board is composed of nine (9) members appointed by the governor.  The governor may remove any member as provided by W.S. 9-1-202.  Members of the board shall be employed in or associated with the travel industry.  Two (2) members shall be designated as at-large members of the board.  Of the seven (7) remaining members, one (1) each shall be appointed from each of the appointment districts set forth in W.S. 9-1-218.

                (c) The tourism board shall be responsible for implementing the tourism program and functions assigned to the Wyoming business council under the Wyoming economic development act, including the expenditure of all funds appropriated for this program.

                (d) The tourism board shall be subject to oversight by the Wyoming business council to assure compliance with the Wyoming economic development act.

                (e) Members of the tourism board shall be compensated in the same manner as members of the Wyoming business council.

                (f) The tourism board shall be appointed and begin exercising its powers no later than April 1, 2003. The board shall exist until July 1, 2004.  Upon termination of the board, its powers shall pass and be vested in the Wyoming business council.".

"1.           (a)  Of this general fund appropriation, one hundred seventy-five thousand dollars shall be expended by the state superintendent of public instruction to establish a pilot project for a voucher system. The project shall:

(i)  Be administered by the state superintendent through the department of education;

(ii)  Operate for school year 2003-2004 only;

(iii)  Be comprised of one hundred (100) public school students enrolled in grade eight (8) during the 2003-2004 school year. The students shall be selected by the state superintendent from applicants without regard to school district, community or county of residence.

(b)  The one hundred (100) students selected pursuant to subsection (a) of this section shall be randomly divided into two (2) groups of fifty (50) subject to the following:

(i)  One (1) group of fifty (50) students shall be enrolled in a nonpublic school and shall receive a payment of up to three thousand five hundred dollars ($3,500.00) during the pilot program, which shall be used to pay tuition costs assessed by the school in which the student is enrolled. The department shall enter into agreements with the parent or guardian of selected students to ensure funding is used exclusively for tuition. Funding for the payments under these agreements shall be from that portion of the school foundation program account funded by the general fund. Any student within this group shall not be counted within the average daily membership (ADM) as computed for the purpose of implementing W.S. 21‑13‑309. Home-based educational programs as defined under W.S. 21‑4‑101(a)(v) are not eligible under this paragraph;

(ii)  The second group of fifty (50) students shall serve as a control group only and shall be counted within the ADM of the school district in which the student resides and attends school.

(c)  The state superintendent shall maintain a record of the results of the statewide assessment in reading, writing and mathematics administered pursuant to law to the one hundred (100) selected students when administered during school year 2003-2004, comparing student performance of the two (2) groups of fifty (50) as established under subsection (b) of this section. Information developed under this subsection shall be used as a basis on which to make recommendations to the legislature under subsection (d) of this section only.

(d)  On or before January 1, 2005, the state superintendent shall report to the legislature on findings under this section with respect to the pilot program and provide recommendations on the future of voucher system in Wyoming education.".

(v)  During the 1994 legislative session, the legislature appropriated funds for capital construction projects and authorized that those projects could be financed under W.S. 9-4-605 through the issuance of revenue bonds.  Interest has accumulated in excess of the amounts necessary to fund the projects in an amount of one million five hundred thousand dollars ($1,500,000.00).  There is appropriated from this excess interest one million five hundred thousand dollars ($1,500,000.00) from this account for the purposes of this section;

(vi)  One hundred fifty thousand dollars ($150,000.00) from the public buildings account created by W.S. 9-4-310(a)(ii) within the permanent land fund.".

(b)  The task force shall meet at the call of the chairman to review and evaluate the existing national pollutant discharge elimination system permit process administered by the water quality division pursuant to the Wyoming Environmental Quality Act.

(c)  The task force shall issue a report to the governor and the joint appropriations interim committee no later than September 1, 2003, that includes recommendations on the following:

(i)  How to effectively and efficiently streamline the permitting and compliance process;

(ii)  Modifications to other state agency requirements that impact the permitting process;

(iii)  Necessary information technology support;

(iv)  Personnel required to implement proposed modifications;

(v)  Draft legislation and proposed rules and regulations necessary to implement the recommendations of the task force.

(d)  The task force shall have the ability to hire or contract for administrative services to aid in preparation of the task force report.

(e)  The task force shall exist until September 30, 2003.  Members of the task force shall not receive a salary but shall receive reimbursement for necessary travel and per diem expenses in the manner and amount provided for state employees under W.S. 9-3-102 and 9-3-103.

(f)  There is appropriated fifty thousand dollars ($50,000.00) from the general fund to the department of environmental quality for expenses incurred pursuant to this section.

(b)  The committee shall be cochaired by the appointed cochairmen.  The cochairmen shall set meeting dates and agendas. The cochairmen may appoint subcommittees to study selected issues relating to juvenile issues.  State agencies shall cooperate with the committee to the extent necessary for the committee to perform its duties under this section.  Staff services shall be provided through the legislative service office.

(c)  Legislators shall be paid salary, travel and per diem for the performance of their official duties as members of the committee as provided in W.S. 28-5-101.  State employees shall be paid salary and travel expenses out of their agency's budget in the performance of their duties on the select committee.  The members of the select committee who are not legislators or state employees shall be paid per diem and travel expenses in the same manner as state employees.

(d)  The select committee shall review the report submitted by the Title 14 Committee to the joint judiciary interim committee on May 1, 2002 and any revisions to that report. Additionally, the select committee shall meet regularly to consider and recommend changes to Title 14 of the Wyoming Statutes.

(e)  The select committee shall report its recommendations to the joint judiciary interim committee no later than September 1, 2003.

(a)  Based upon the hardware and functionality requirements specified by the standards and body of evidence tracking (SBET) advisory group established by the state superintendent of public instruction, the state department of education shall acquire necessary data software to support the requirements of the body of evidence assessment systems implemented by school districts as required by W.S. 21‑3‑110(a)(xxiv) to determine levels of student performance and to comply with state graduation requirements.  To implement this section, the department shall develop and issue a request for proposal (RFP) in consultation with the SBET advisory group, enabling software to be fully functional by school year 2004-2005.  The SBET advisory group shall assist the department in reviewing and evaluating all proposals submitted in response to the RFP.  Following review and evaluation and if a proposal is accepted, meets the requirements of this section and is approved by the SBET advisory group, the state department shall enter into contract to implement the proposal subject to available funds appropriated under subsection (c) of this section sufficient to implement its provisions.

(b)  In addition to subsection (a) of this section, the state department shall purchase necessary server hardware for those districts not capable of using software acquired under this section with existing hardware and shall provide training to school district personnel in the use of computer software for tracking student performance and body of evidence information.

(c)  Four million three hundred twenty-five thousand dollars ($4,325,000.00) is appropriated from the school foundation program account within the special revenue fund to the state department of education to implement this section.".

Section 328.

(a)  A design team is established to assist the state superintendent of public instruction in the investigation, development and implementation of a statewide education data system specified under subsection (b) of this section.  The design team shall be comprised of the following:

(i)  Two (2) members appointed by the state superintendent of public instruction, with expertise in education data technology and data systems;

(ii)  Two (2) members who are employed by Wyoming school districts as technology directors and are appointed by the state superintendent of public instruction with the advise of district directors of technology;

(iii)  One (1) Wyoming school district superintendent selected by the Wyoming association of school administrators;

(iv)  One (1) member of the Wyoming senate appointed by the president of the senate;

(v)  One (1) member of the Wyoming house of representative appointed by the speaker of the house.

(b)  The statewide education data system shall provide a statewide capability to share and access educational information between school districts and the state, through common labeling and storage of data, both internally for school district use and externally for state and federal data collections.  To the extent possible, the data system shall use existing data bases of districts and the state, and focus on acquiring the necessary system components to enable uniform, statewide reporting of educational information.

(c)  The state superintendent of public instruction shall in consultation with the design team established under subsection (a) of this section, develop and issue a request for proposal (RFP) in conformance with this section which at minimum shall include:

(i)  Requirements for universal school district participation in the statewide education data system following complete analysis and review of data systems existing within districts and necessary modifications to achieve district compliancy;

(ii)  Infrastructure necessary to support the statewide education data system;

(iii)  Training requirements for district participation;

(iv)  A thorough review of system feasibility including the use of test surveys and pilot projects.

(d)  The design team shall advise the state superintendent of public instruction in developing the RFP required under this section and assist the state superintendent in reviewing and evaluating all proposals submitted in response to the RFP.  Following review and evaluation, the state superintendent shall, if a proposal is accepted and meets the requirements of this section, enter into contract to implement the proposal subject to available funds appropriated under subsection (d) of this section.

(e)  On or before December 31, 2003, and on behalf of the design team, the state superintendent of public instruction shall report to the joint education interim committee on a proposed statewide data system developed pursuant to this section.  Recommendations shall be structured to enable implementation during the 2005-2006 school year, and shall include necessary enabling legislation.".

(b)  In conducting the survey, the department may require any business entity currently doing business in the state to submit to the department an estimate of the gross revenues received from the business entity's operations in the state during the previous calendar year. The reports shall be kept confidential by the department and shall be used only for the purposes of the survey and subsequent legislative study under this section.  The survey shall include the following:

(i)  Review possible options for a basis of a business tax including business income tax, franchise fees, gross receipts, net income, net worth, value-added or a combination thereof;

(ii)  Analyze the various rates of business taxes including flat rate, graduated rate or a combination thereof;

(iii)  Analyze the potential impact upon the current Wyoming license tax structure for business entities;

(iv)  Develop and recommend any appropriate tax credits, exemptions or deductions;

(v)  Develop the factors to be used to determine the proper apportionment of assets and income of a business located in more than one (1) state;

(vi)  Consider appropriate tax incentives and abatements.

(c)  The department shall report its findings with any recommendations to the joint revenue interim committee on or before August 31, 2003.".
