Call To Order (April 19, 2006)

Chairman Geis called the meeting to order at 8:30 am.  The following sections summarize the Committee proceedings by topic.  The order of the meeting generally followed the prepared agenda [Appendix 3]. 

 

Executive Summary

The Committee took testimony from numerous people before working the bill.  The Committee made several amendments to the bill  and then tabled the bill to the next meeting.

Generally, the following spoke against the draft bill:  Len Mize and Dick Sears with Kinder Morgan, Pat Collins and John Sherman with the Wyoming Department of Transportation, Steve Waddington, Executive Director of the Wyoming Infrastructure Authority, Kathy Hunt and George Parks with the Wyoming Association of Municipalities, Daniel Gredvek with El Paso Gas, Wendy Lowe and Bruce Hinchey, representing the Petroleum Association of Wyoming, Bob Tarantola and Erik Gril representing PacifiCorp and Rocky Mountain Power, Matt Micheli representing Williams pipelines, Chuck Greenhawt representing Questar, Tom Jones with the National Federation of Independent Business, Jody Levin with Qwest, Vincent Crow representing the City of Rock Springs, Marion Loomis representing the Wyoming Mining Association, Rick Robitaille representing Anadarko, Colby Dreschel representing the Wyoming Pipeline Authority, Rick Kaysen representing Blackhills Corporation and Cheyenne Light Fuel and Power and Bill Luben representing the City of Casper.

 

Lynne Boomgaarden, Director of the Office of State Lands and Investments explained how her office handles leases and easements on state lands.

Senator Meier moved bill and the motion was seconded [Appendix 25].

 

Senator Meier moved on Page 2 to delete lines 4 through 6 and renumber.  The motion failed for lack of a second.

 

Senator Meier moved on Page 3-line 2 after "negotiations" to insert “and any action by condemnor that causes any loss to condemnee is provided for”.  Representative Brown seconded the motion and the motion passed.

 

Representative Semlek moved on Page 3–line 10 after "exceeds" to insert "by fifteen percent (15%) of".  The motion was seconded by Senator Meier and passed.

 

Senator Meier moved on Page 3–line 12 after "action;" to insert “and”; Page 3-line 15 to delete “or”; Page 3 to delete lines 17 and 18.  Representative Brown seconded the motion and the motion passed.

 

Representative Semlek moved on Page 4-line 21 to delete “condemnor’s” and insert “condemnor for three (3) years following”.  Senator Vasey seconded the motion and the motion passed.

 

Senator Meier moved to amend the amendment on Page 4-line 21 after "operations" to insert ", excluding the cost of noxious weeds".  The motion was seconded by Representative Semlek  and the amendment to the amendment passed.

 

The amendment as amended passed.

 

Senator Meier moved on Page 6 to strike lines 4 through 6 and renumber.  After a second by Representative Brown the motion failed.

 

Representative Semlek moved on Page 7-line 18 after "corridor" to insert "or an existing contractual access if available".  Senator Meier seconded the motion and the motion passed.

 

Senator Meier moved on Page 7–line 18 after the Semlek amendment on page 7 to insert "unless as a matter of national security or relating for utilities as determined by a state or federal agency determines otherwise".  The motion was seconded by Representative Davison and failed.

 

Representative Jackson moved on Page 8-line 13 after "public" to insert “or private”.  The motion was seconded by Senator Meier and passed.

 

Senator Meier moved on Page 9 to delete line 23 and renumber.  Representative Brown seconded the motion and the motion passed.

 

Senator Meier moved on Page 12 after line 18 to insert new “(j)  Any action by condemnor that causes any loss to condemnee is compensable." and renumber.  Representative Brown seconded the motion and the motion passed.

 

Senator Meier moved on Page 19–line 7 after "landowner" to insert "No liability, environmental or otherwise, shall be transferred to the landowner by abandonment."  After a second by Representative Teeters the motion passed.

 

Representative Samuelson moved on Page 19-line 21 through Page 23-line 11 to delete sections 701 and 702 for now and leave these sections as a placeholder spot for language for the next meeting.  The motion was seconded and passed.

 

Senator Meier moved to table the bill to next meeting.  After a second by Representative Davison the motion passed [Appendix 26].

 

 

Meeting Adjournment

The next Committee meeting is scheduled in Sundance, Wyoming on October 26 and 27, 2006.  There being no further business, the meeting was adjourned at 6:00 p.m.
