SUBJECT:                                       Chapter 17, Section 3, Fees and State Loan and Investment Board and Chapter 14, Section 3, Fees.

 

NATURE OF RULES:                   Legislative and procedural.

 

STATUTORY AUTHORITY:        W.S. 11-34-103(a), 36-2-107, 36-3-110 and 16-4-204(d).       

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED TO THE AGENCY BY LSO:  Apparently complete to date.

 

SUMMARY OF RULES:

 

The purpose of these rules is to allow the Office of State Lands and Investment to establish and charge fees to cover the cost of services and materials associated with supplying copies to persons requesting a review of public records held by the Office of State Lands and Investments. Specifically the rules are being amended as follows:

 

·         Chapter 14, Section 3 allows the State Land and Investment Board to establish by annual resolution reasonable fees and charges to be assessed for the costs and services set forth in the Wyoming Public Records Act.

 

·        Chapter 17, Section 3 allows the Board of Land Commissioners to establish by annual resolution reasonable fees and charges that may be assessed for the costs and services set forth in the Wyoming Public Records Act.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
