SUBJECT:                                       Chapter 8, School Foundation Program.

 

NATURE OF RULES:                   Legislative and Procedural.

 

STATUTORY AUTHORITY:        W.S. 21‑2‑202(a)(i) and (e) and 21‑2‑203(a).

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:

            Apparently complete to date.  Notice of proposed adoption of new rules was provided by this office as required by W.S. 28‑9‑103(d).  No comments have been received to date.

 

SUMMARY OF RULES:

            The permanent rules modify Agency rules for foundation program administration as necessary for implementation of the recalibrated education resource block grant model as enacted under 2006 Laws, Chapter 37, and in particular, prescribe a process for technical corrections to the block grant model as directed by W.S. 21‑2‑202(e).  The permanent rules were previously submitted to Council members under Emergency Rule Review Report #ER06-40 dated September 1, 2006.

 

FINDINGS:

          The permanent rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:

            That the permanent rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
