NATURE OF RULES:                      Legislative and procedural.

 

STATUTORY AUTHORITY:           W.S. 23-1-302 and 23-2-104.

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:    The rules set the seasons and bag limits for black bear hunting.  The rules also provide regulation and registration requirements for use of bait sites.  The rules clarify that bait sites are not transferable between persons and change the preference period for re-registration of bait sites.  The rules provide that bear baiting will not be allowed in the area to be designated as a grizzly bear recovery area.  While the exact location of that area is not determined, the rules provide a method for obtaining the location when it is established.

 

FINDINGS: 

The rules appear to be within the scope of statutory authority and legislative intent.    

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and approved by the Council as submitted by the Agency.
