SUBJECT: Chapter 39, Driver Education Program Approval.

NATURE OF RULES:                   Legislative and Procedural.

STATUTORY AUTHORITY:        W.S. 21‑3‑501(e).

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:

            Apparently complete to date.  Notice of proposed adoption of new rules was provided by LSO as required by W.S. 28‑9‑103(d).  No comments have been received to date.

SUMMARY OF RULES:

            The permanent rules implement 2006 Wyoming Laws, Chapter 25, pertaining to drivers' education course certification and standards for drivers' education programs in high schools, private schools, community colleges, BOCES, community education programs and drivers' education schools.  The rules have been previously submitted to Council members under Emergency Rule Review Report #ER06-17 dated June 26, 2006, and again under Emergency Rule Review Report #ER06-44 dated October 18, 2006.

FINDINGS:

            The permanent rules appear to be within the intent and scope of statutory authority and legislative intent.

STAFF RECOMMENDATION:

            That the permanent rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
