Legislative Service Office

24-May-07

AGENCY:                                       Professional Teaching Standards Board.

DATE SUBMITTED:                     May 23, 2007.

SUBJECT:                                       Chapter 10, Advanced Programs with Teaching Certificates; and Chapter 11, Advanced Programs Without Teaching Certificates.

NATURE OF RULES:                   Legislative and Procedural

STATUTORY AUTHORITY:        W.S. 21-2-802

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

SUMMARY OF RULES:  The rules amend chapters 10 and 11 of the permanent rules of the Board by moving programs that prepare school guidance counselors from chapter 10 which would require a teaching certificate to chapter 11 which is for programs which do not require a teaching certificate.  The change will allow a person to complete a program to become a school guidance counselor without requiring the person to obtain a teaching certificate.

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Board.
