Legislative Service Office

29-May-07

AGENCY:                                       Department of Employment, Workers' Compensation Division.

DATE SUBMITTED:                     May 25, 2007.

SUBJECT:                                       Chapter 1, Section 4, Definitions; and Chapter 2, Section 1, Proof of Coverage (POC) Certificate.

NATURE OF RULES:                   Legislative.

STATUTORY AUTHORITY:        W.S. 27-14-302(b), 27-14-802(a).

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:                       Apparently complete to date.

SUMMARY OF RULES:      The Wyoming Workers' Compensation Act W.S. 27-14-302(b) requires a non-resident employer, before commencing business in Wyoming, to submit to the Workers' Safety and Compensation Division either a deposit toward future premiums or a surety bond or other acceptable security with the Division.  This requirement may be waived if the nonresident employer provides a proof of coverage certificate pursuant to W.S. 27-14-306(b), indicating that the Wyoming employees are covered by an out-of-state workers' compensation policy.

These minor amendments to the Division's existing rules add a definition of "other security" and stipulate the required contents of a proof of coverage certificate.

FINDINGS:    The rules appear to be within the scope of statutory authority and legislative intent.

STAFF RECOMMENDATION:       That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
