SUBJECT:                                        Chapter 5, Section 10, Administering the Teacher Shortage Loan Repayment Program;  and Section 11, Administering the Tuition Benefit for Vietnam Veterans, Overseas Combat Veterans and Surviving Spouses and Orphans.

 

NATURE OF RULES:                      Legislative and Procedural.

 

STATUTORY AUTHORITY:           W.S. 19‑14‑106(d), 21‑7‑601(j) and 21‑18‑202(f)(v).

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:

            Apparently complete to date.  Notice of proposed adoption of new rules was provided by this office as required under W.S. 28‑9‑103(d).  No comments have been received to date.

 

SUMMARY OF RULES:

            The permanent rules implement provisions of Original House Bill 0112 (2007 Laws, Chapter 91) and Original House Bill 0182 (2007 Laws, Chapter 174).  The rules amend Chapter 5, Section 10, to expand the teacher shortage loan repayment program to include students enrolled in University of Wyoming foreign language instruction programs in addition to special education, math and science instruction programs, and amend Chapter 5, Section 11 to provide consistent benefit and eligibility requirements for eligible veterans and dependents under the tuition benefit program for Vietnam veterans, overseas combat veterans and surviving spouses and orphans.

 

FINDINGS:

            The permanent rules appear to be within the intent and scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:

            That the permanent rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
