NATURE OF RULES:                     Procedural.

 

STATUTORY AUTHORITY:         W.S. 35-1-428

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:       The Department of Health administers the state office of vital records pursuant to W.S. 35-1-401 through 431.  The statute requires the Department to charge reasonable fees for certified copies of certificates or records, W.S. 35-1-428.  This rule amendment increases fees by one dollar per certified copy to offset a general fund increase of $120,000 in the 2007-2008 biennial budget.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
