NATURE OF RULES:                     Legislative.

STATUTORY AUTHORITY:         W.S. 27-3-602(a)(i).

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:              Apparently complete to date.

SUMMARY OF RULES:        WS. 27-3-503 of the Wyoming Employment Security Law requires employers to contribute to the unemployment compensation fund in an amount equal to a percentage of employee wages.  This amendment adds a new section to existing rules to provide guidance in distinguishing expense reimbursements or advances, which are not subject to the contribution formula, from employee wages.

FINDINGS:     The rules appear to be within the scope of statutory authority and legislative intent.

STAFF RECOMMENDATION:         That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
