NATURE OF RULES:                     Legislative and procedural.

 

STATUTORY AUTHORITY:         W.S. 20-6-106(n).

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:        The Wyoming Child Support Enforcement Act, W.S. 20-6-101 et seq., requires the Department of Family Services to administer a program, consistent with federal law and regulations, to enforce orders for child support and the provision of health insurance for children.  This amendment to existing rules implements a requirement of the federal Deficit Reduction Act of 2005, which requires that child support orders being enforced under Title IV-D of the Social Security Act be reviewed for possible modification every three years.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:         That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
