SUBJECT:                                 Chapter 28, Unfunded or Partially Funded Large Capital Construction Projects-Individual Applications; and Chapter 29, Investment Grade Energy Audits-Individual Applications.

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO: 

Apparently complete to date.  Notice of the proposed adoption of new rules was provided by the LSO as required by W.S. 28‑9‑103(d).  No comments have been received to date.

 

SUMMARY OF RULES: 

Generally, these new rules explain changes in distributions to local governments pursuant to 2008 Wyoming Session Laws, Chapter 48, Section 330(b).  The rules define funding availability, grant eligibility, application procedures, evaluation criteria, board consideration, grant disbursement and administration, audits and inspections. 

 

More specifically:  Chapter 28 addresses distributions to local governments for unfunded or partially funded large capital construction projects or for operating grants.  Chapter 29 provides for grants to local governments to perform investment grade energy audits.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
