DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION
SUBMITTED BY THE AGENCY TO LSO: Apparently complete to date. Notice of the proposed adoption of new rules was provided by the LSO as required by W.S. 28-9-103(d). No comments have been received to date.
SUMMARY OF RULES: The Wyoming Emergency Medical Services Act of 1977, W.S. 33-36-101 through 113, directs the Department of Health to regulate the licensing of emergency medical services in the state. The Department's rules were last revised in January, 2004. These amendments implement changes made by the 2008 Legislature (SF62 / SEA 51 / Ch. 122) and update terminology and procedures to reflect current practices. The amendments:
· Create a new chapter establishing criteria for the payment of stipends to physician medical directors of ambulance services;
· Revise definitions;
· Require EMT applicants to submit information for a criminal background check;
· Revise criteria for the approval of continuation education programs;
· Revise subject matter requirements for continuing education in the various categories of EMT licensees.
FINDINGS: The rules appear to be within the scope of statutory authority and legislative intent.
STAFF RECOMMENDATION: That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
