STATUTORY AUTHORITY:         W.S. 21-18-202(c)(i).

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:  The rules being amended deal with the funding model for community colleges.  These rules will serve as a placeholder until the Commission receives recommendations from the Community College Task Force concerning the changes the Task Force is considering to the community college system and the funding model.  The existing rules are amended at this time to provide that if the comparator based funding model is determined not to be the appropriate method for determining the funding request for the colleges, funding requests for specifically identified needs may be submitted in the biennial budget request.  The rules are also amended to provide that the recapture and redistribution of state revenues due to changes in local 4-mill revenue which results from changes in assessed valuation will be distributed to each college based on the college's proportionate share of credit full time equivalent enrollment for the two most recent years until an approved model is in place.  The existing rules are amended to specifically recognize the permanent rules adopted April 5, 2005.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by Council as submitted by the agency.
