AGENCY:                                 Game and Fish Department.

 

DATE SUBMITTED:                   March 16, 2009.

 

SUBJECT:                                 Chapter 44, Issuance of Licenses, Permits, Stamps, Tags, Preference Points, and Coupons.

 

NATURE OF RULES:                     Legislative and procedural.

 

STATUTORY AUTHORITY:         W.S. 23-1-302.

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:  The Game and Fish Commission is eliminating the use of leftover drawings to distribute extra licenses remaining in hunt areas after the initial drawing is completed.  The commission will be selling those licenses electronically on a first come-first served basis.  These rules provide the framework for those sales.  In addition to other minor technical wording corrections, the rules also clarify that preference points are non transferable.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the consent list and approved by the Council as submitted by the agency.
