AGENCY: Board of Nursing.

SUBJECT: Chapter 4, Advanced Practice Registered Nurse.

NATURE OF RULES:                     Legislative, procedural

STATUTORY AUTHORITY:         W.S. 33-21-122(b) and (c).

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.  Notice of the proposed adoption of new rules was provided by the LSO as required by W.S. 28-9-103(d).  No comments have been received to date.

SUMMARY OF RULES:  These rules deal with advanced practice registered nurses.  Technical corrections are made throughout the rules.  In section 1 the rules are amended to establish the types of nurses that are considered advanced practice registered nurses and to clarify the behaviors that are considered to impair the nurse's ability to practice.  Section 3 is amended to revise the requirements for initial recognition as an advanced practice nurse.  Section 4 establishes the requirements for a graduate temporary permit.  Section 5 revises the requirements for renewal of advanced practice registered nurse recognition.  Section 6 clarifies the education programs that are accepted by the board.

Section 8 is revised for clarity and to require a certain number of contact hours in pharmacology or pharmacotheraputics every two years.  Section 11 clarifies the grounds for discipline of an advanced practice registered nurse.

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

STAFF RECOMMENDATION:  That the rules be placed on the Consent list and be approved by the Council as submitted by the Agency.
