SUBJECT: Chapter 36, Fraternal Benefit Societies (Repeal); and Chapter 62, Use of Senior-Specific Certifications and Professional Designations.

STATUTORY AUTHORITY: W.S. 26-13-104 and 26-9-211
DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO: Apparently complete to date.
SUMMARY OF RULES: Chapter 36, applying to fraternal benefit societies is being repealed. The certifications required under this chapter are redundant with provisions in other insurance department rule chapters.
Chapter 62 sets standards for the use of senior specific certifications and professional designations by insurance providers. The chapter prohibits the use of such senior specific designations when used in a way to mislead the public that the insurer has some special certification or training in advising or servicing seniors.
FINDINGS: The rules appear to be within the scope of statutory and legislative intent.
STAFF RECOMMENDATION: That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
