AGENCY: Public Service Commission.

SUBJECT: Chapter 5, Rules 501(c)(x), (xvi), 507(b), 510(b)(i) and 511(b)(ii), Docket No. 90000-109-X0-09 (Record No. 12078).
NATURE OF RULES: Legislative and procedural.
STATUTORY AUTHORITY: W.S. 37-15-401(a)(iii)
DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO: Apparently complete to date.
SUMMARY OF RULES: Under current rules a telecommunications company is required to provide local exchange services, where facilities exist, within five working days of a customer's request. The amended rules require provision of those services within five working days 95% of the time.
The amended rules repeal specific requirements for Bit Error Ratios in digital circuit performance standards and instead reference national standards set by the American National Standards Institute.
As proposed, the rules made several other changes that the Commission chose not to adopt at this time.
FINDINGS: The rules appear to be within the scope of statutory authority and legislative intent.
STAFF RECOMMENDATION: That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
