NATURE OF RULES: Legislative and procedural.
STATUTORY AUTHORITY: W.S. 42-3-103(b), (f)
DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO: Apparently complete to date. Notice of the proposed adoption of new rules was provided by the LSO as required by W.S. 28-9-103(d). No comments have been received to date.
SUMMARY OF RULES: The Department of Family Services administers a program, funded through a federal block grant, to assist working low-income families with the purchase of child care services. These amendments to existing rules implement changes enacted by 2010 Wyoming Laws, Chapter 31. The amendments:
• Reduce program eligibility to 225% of the federal poverty level from the current level of 250%;
• Implement a sliding scale parental co-payment formula;
• Remove job search as an approved employment activity, as the temporary funding for that under the American Recovery and Reinvestment Act has expired.
FINDINGS: The rules appear to be within the scope of statutory authority and legislative intent.
STAFF RECOMMENDATION: That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
