SUBJECT: Chapter 5, First Responder Fund.

NATURE OF RULES:                     Legislative

STATUTORY AUTHORITY: W.S. 19-11-115(f)

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.  Notice of the proposed adoption of new rules was provided by LSO as required by W.S. 28-9-103(d).  No written comments have been received to date.

SUMMARY OF RULES:        These new rules are intended to implement 2009 Wyo. Sess. Laws, Chap. 109, which requires the Adjutant General to adopt rules establishing a method for application by any Wyoming resident who is not a member of the Wyoming National Guard to have his retirement contributions paid by the Adjutant General while the person is deployed as a first responder by the federal government under title 10 of the United States Code.

FINDINGS:     The rules appear to be within the scope of statutory authority and legislative intent.

STAFF RECOMMENDATION:  That the rules be placed on the consent list and be approved by the Council as submitted by the Agency.
