NATURE OF RULES:                                   Legislative.

 

STATUTORY AUTHORITY:                          W.S. 27-11-105(b).

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:  These amendments to existing OSHA rules update standards for the safe use of cranes and derricks in construction.  The revised rule:

    Updates references to standards of the American National Standards Institute that are incorporated by reference in the rules;  

    Reflects advances in the design of cranes and derricks since the rules were promulgated;

    Requires employers to assess associated work area risk factors such as ground stability, presence of power lines and proximity of workers;

    Requires periodic inspections of lifting equipment;

    Requires training of workers to recognize specific hazards in the use of lifting equipment.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
