Administrative Rule Review Report  #AR11-015

Legislative Service Office

11-Apr-11

AGENCY:                                 Office of State Lands and Investments.

DATE SUBMITTED:                   April 8, 2011.

SUBJECT:                                 Chapter 16, Surface and Subsurface Survey Activities.

NATURE OF RULES:                     Procedural and legislative.

STATUTORY AUTHORITY:         W.S. 36-2-107(a).

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Appears to be complete.

SUMMARY OF RULES:  The rules are intended to address findings presented in a March 26, 2010 Program Evaluation Report conducted by the Legislative Service Office.  The report concluded that the Office of State Lands and Investments needed a more formal agreement for allowing survey activities on State lands.  The rules require that an application for authorization to conduct surveys be filed when a surveyor is requesting permission for any type of survey on State land.

FINDINGS:  The rules appear to be within the scope of statutory and legislative intent.

STAFF RECOMMENDATION:  That the rules be placed on the consent list and be approved by the Council as submitted by the Agency.
