STATUTORY AUTHORITY:         W.S. 21‑2‑202(a)(xxxi), 21‑13‑330

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.  Notice of the proposed adoption of the new rules was provided by the LSO as required by W.S. 28-9-103(d).  No comments have been received to date. 

 

SUMMARY OF RULES:  These proposed provide new definitions of "distance education program provider" and "milestones".  The rules also provide for a process for Wyoming school districts to accept credits from an out-of state distance education program provider.  The rules as amended revise the process for distance education programs to enroll students and specify the process for a resident district to remove a student who is participating full time in a distance education program at a nonresident district.  The rules are also amended to provide that extracurricular activities are included within educational support provided to students by the resident district within the memorandum of understanding.  Additional technical changes are made throughout the rules.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
