SUBJECT:                                         Chapter 45, Wyoming Main Street Program.

 

NATURE OF RULES:                       Legislative, procedural

 

STATUTORY AUTHORITY:             W.S. 11-45-101, amended and renumbered by 2007 Wyo. Sess. Laws, Ch. 101.       

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO: Apparently complete to date.  Notice of the proposed adoption of new rules was provided by the LSO as required by W.S. 28-9-103(d). No comments have been received to date.

SUMMARY OF RULES:  The Chapter 45, Wyoming Main Street rules and regulations are being repealed by the Wyoming Department of Agriculture.  The governing Wyoming statutes were amended and renumbered by 2007 Wyo. Sess. Laws, Ch. 101 which moved the governing authority from the Wyoming Department of Agriculture to the Wyoming Business Council.  As such, this program is no longer within the statutory authority of the Wyoming Department of Agriculture and repeal is appropriate.  

 

FINDINGS: The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION: That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
