SUBJECT:                                        Chapter 1, General Eligibility Requirements; and Chapter 2, Work Requirements.

 

NATURE OF RULES                    Legislative and procedural.

 

STATUTORY AUTHORITY         W.S. 42-2-103(b)(xiv).

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:      The Department of Family Services administers the federal Supplemental Nutrition Assistance Program ("SNAP", formerly known as the Food Stamp Program), pursuant to a SNAP State Plan submitted to and approved by the United States Department of Agriculture.  Available state options and waivers are identified in the State Plan.  These amendments to existing rules:

 

·         Make non-substantive organizational changes, and terminology and grammatical corrections;

·         Delete from the rules provisions concerning employment and training requirements, which duplicate requirements covered in the State Plan and which can fluctuate from year to year pursuant to federal law;

·         Provide for temporary lifting of limits on benefits for Able Bodied Adults Without Dependents, when those limits are periodically suspended by federal law.

 

FINDINGS:   The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:       That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
