SUBJECT:                                        Chapter 2, Services for Miners.

 

NATURE OF RULES:                     Legislative and procedural.

 

STATUTORY AUTHORITY:         W.S. 30-6-102(b)(iii).

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:      The State Miners' Hospital Board administers an account to "[s]erve disabled or incapacitated miners in this state with emphasis on pulmonary/respiratory, hearing loss, cardiac and musculoskeletal conditions of miners due to labor in the mining industry."  W.S. 30-6-102(b)(i).  The account is funded from interest earned on the miner's hospital account within the permanent land income fund.  The Board's existing rules address program eligibility and benefits available.  This amendment:

 

·      Provides that the program's prescription drug benefits shall be secondary to to any other prescription drug insurance benefit available to the miner;

·      Provides for reimbursement of out-of-pocket prescription drug costs for miners having other prescription drug coverage, and for issuance of a card allowing direct payment of prescription drug benefits at the point of sale for miners who have no other prescription drug coverage.

 

FINDINGS:    The rules appear to be within the scope of statutory authority and legislative intent.                     

STAFF RECOMMENDATION:       That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
