Catch Title:       Streamlined sales tax.

 

Subject:  Provides extensive amendments to the sales/use tax laws in order to conform with the streamlined sales tax agreement (SSTA).

 

Summary/Major Elements:

 

·        Voluntary licensure:  Provides that vendors who voluntarily comply with the sales/use tax laws in this state by becoming licensed and collecting sales and use taxes from purchasers in this state, shall not be subject to audit prior to the date of licensure if the licensure occurs within 12 months of the effective date of the SSTA.

 

·        Provides extensive definitions to comply with the SSTA.

 

·        Provides immunity for vendors who rely upon erroneous sales/use tax rate information provided by the department of revenue.

 

·        If a taxpayer erroneously pays a tax and then asks for a refund from the vendor, no cause of action lies against the vendor if the vendor refunds the tax in less than 60 days following the date of the request.

 

·        Provides mirror provisions for the use tax laws.
