Catch Title:       Illegal open house parties for minors.

 

Subject:  Establishes a crime for allowing a house party if alcohol or a controlled substance is possessed or consumed as specified.

 

 

Summary/Major Elements:

·        This bill:

·        Establishes a crime in instances where a person who owns, leases, subleases or has control of a residence allows a house party and knowingly permitted alcohol or a controlled substance to be possessed or consumed by any minor;

·        Exempts situations where alcohol is provided to a person under age 21 who has a specified familial relationship with the person who provided the alcohol, the alcohol was part of a religious observation or prescribed medical treatment, or  the possession of the alcohol was incidental to lawful employment;

·        Provides a misdemeanor penalty of up to $750.00, 6 months in jail, or both;

·        Defines "minor" as anyone who is 18 years of age and defines "premises" to include hotel and motel rooms, a manufactured home or any private or public facility that is not licensed to dispense alcohol beverages.
