Summary/Major Elements:

·        Under current law,  if, after hearing and investigation, the Public Service Commission finds a rate to be inadequate or unremunerative, unjust, unreasonable or unjustly discriminatory, the Commission may fix and substitute a rate it determines to be just and reasonable for a time to be fixed at the discretion of the Commission.

 

·        This bill allows the Commission to fix and substitute a rate it determines to be just and reasonable for a rate that it finds to be otherwise for an initial period of 6 months, which rate may be extended for an additional period or periods, not to exceed a total of 3 months.
