Subject:  Amends Long Term care Ombudsman Act

 

Summary/Major Elements:

 

·        This act makes numerous updates to the Long Term Care Ombudsman Act, including:

 

o       Extension of ombudsman authority to persons receiving long term care services at any type of licensed care facility;

 

o       Clarification that ombudsman authority to investigate and mediate complaints regarding care is not an investigation for licensing or certification purposes;

 

o       Removal of requirement that ombudsman give prior notice to  care facility before initiating complaint inquiry or entering care facility;

 

o       Removal of provider's right to appeal ombudsman's findings, replaced with direction that ombudsman refer unresolved problems for appropriate administrative action.
