Catch Title:       Uniform Interstate Family Support Act.

 

Subject:  Amends the Uniform Interstate Family Support Act (UIFSA).

 

Summary/Major Elements:

·         This bill:

·         Amends the UIFSA (enacted in 1995) to specify when a court of this state has or may obtain jurisdiction over family support issues;

·         Specifies that this act does not confer jurisdiction over custody or visitation matters;

·         Amends definitions to account for determining the controlling jurisdiction between the state and jurisdictions in foreign countries that have reciprocal agreements with the United States and to authorize receipt of records that are transmitted by electronic or other media and that are retrievable in a perceivable form;

·         Provides procedures for determining who has controlling jurisdiction among jurisdictions that could each otherwise assert jurisdiction over the parties or the subject matter;

·         Distinguishes between initiating, controlling and exclusive jurisdiction and what matters may be considered by the court having any such jurisdiction;

·         Establishes procedures for determining which will be the controlling child support order if 2 or more jurisdictions have issued support orders and how credits shall be issued for child support payments received by a jurisdiction with, or without, proper jurisdiction;

·         Specifies duties of the child support enforcement agency (DFS in Wyoming);

·         Authorizes the Attorney General to determine if a foreign jurisdiction has a reciprocal agreement with the U.S.;

·         Provides that a voluntary acknowledgment of paternity is admissible to establish paternity.
