Catch Title:       Uniform Athlete Agents Act.

 

Subject:  Regulates athletic agents doing business in Wyoming.

 

Summary/Major Elements:

 

·         Requires any person entering into an agency contract with a student athlete in Wyoming to provide a disclosure to the student athlete unless the student athlete, or someone acting on his behalf, initiates the contact.

·         Provides that any contract entered into between a student athlete and an athlete agent is void unless the disclosure required under the act is provided within seven days of initial contact.

·         Specifies disclosures which must include be made by the agent;.

·         Provides for submission of proof of registration in another state within the previous six months in lieu of the required disclosure.

·         Disqualifies persons from acting as an athlete agent in Wyoming if the person has been convicted of a felony or a crime of moral turpitude, or for other specified reasons.

·         Prescribes the form of contract between student athletes and athletic agents.

·         Provides for notice to the athletic director of the education institution when the parties enter into a contract.

·         Provides the student athlete fourteen days in which to cancel the agency contract without incurring costs.

·         Requires retention of contracts and information for five years.

·         Prohibits agents from inducing student athletes to enter into agency contracts by furnishing the athlete with anything of value prior to entering the contract or by furnishing anything of value to any other individual.

·        Provides for criminal and civil penalties for violation, including allowing civil penalties to be collected by the educational institution where the student athlete plays.
