Catch Title:       Surplus medication.

 

Subject:  Creates a program for the donation and dispensing of unused prescription drugs.

 

Summary/Major Elements:

 

·        Creates the Drug Donation Program Act to be administered by the Department of Health.

 

·        Allows any person or entity to donate surplus prescription drugs to the program, if the drugs are unexpired, unopened and sealed in original packaging.

 

·        Authorizes dispensing of the donated drugs pursuant to prescription by another participating physician, pharmacy or health care facility, but prohibits resale.

 

·        Provides immunity from civil or criminal liability for any person who exercises reasonable care in donating, accepting distributing or dispensing drugs under the program.

 

·        Directs the Department of Health, in cooperation with the Board of Pharmacy, to promulgate rules and regulations implementing the program.  Rules shall specify eligibility criteria, handling procedures, forms, allowable handling fees and categories of drugs accepted by the program.

 

·        Appropriates $23,200.00 in general funds and authorizes one part-time position to the Department of Health.
