·        Establishes a crime for the illegal use of a scanning device or re-encoder to capture information from a credit, debit or other electronic payment card;

 

·        Provides that unlawful skimming is punishable by:

·        Not more than 5 years imprisonment, not more than $10,000, or both, for a first conviction;

·        Not more than 10 years imprisonment, not more than $25,000, or both, for a second or subsequent conviction;

 

·        Provides definitions for "authorized card users", "merchants", "electronic payment cards", "re-encoders" and "scanning devices".
