Summary/Major Elements:

 

·        Under current law, a noncustodial parent paying child support may request an abatement of ½ the daily child support for any periods where the parent has custody of the child for 15 or more consecutive days.  Any overnight or weekend period the child is with the custodial parent is disregarded for purposes of computing the 15 consecutive day requirement for abatement purposes.

 

·        This bill defines "weekend" for purposes of abatement to mean any 2 consecutive day period, except if a legal holiday precedes or follows the days constituting the weekend, the weekend shall consist of 3 days.
