Subject:  Establishes an "intermediate driver's permit" for specified drivers under age seventeen.

 

Summary/Major Elements:

 

This act:

 

·         Creates a graduated driver's license, or "intermediate permit," for drivers who are under age 17;

 

·         Provides that a regular driver's license shall not be issued until a person turns 18, or has held an intermediate permit for six months and has completed driver's education;

 

·         Requires at least 50 hours of practice driving, including 10 hours of night driving, under an instructional permit before issuance of an intermediate permit;

 

·         Restricts holders of an intermediate permit to:

 

o        One passenger under the age of 18 unless accompanied by a licensed driver over 18;

 

o        Driving between 5:00 a.m. and 11:00 p.m. unless accompanied by a licensed driver over 18, required to drive by medical necessity or emergency, driving to or from work, driving to or from school, sports  or religious activities;

 

·         Provides for 30-day suspension for violation of the permit restrictions, but provides that violations shall not be reportable to insurance companies or used as the basis for any insurance premium increase;

 

·        Provides that this act is effective September 16, 2005, and does not apply to hold a valid driver's license on that date from Wyoming or another state.
