Summary/Major Elements:

 

·        This act:

 

o       Authorizes the department of health to contract with providers of services under the Medicaid home and community based waiver ("HCBW") program;

 

o       Requires the department to adopt certification standards for HCBW service providers;

 

o       Mandates that HCBW service providers under contract with the department be in compliance with applicable licensing and certification standards;

 

o       Authorizes the department to impose civil fines on HCBW service providers who chronically fail to meet standards or who create continuing threats to the safety of Medicaid recipients.
