Catch Title: Soliciting minors.
Subject: Amends elements of the crime of soliciting minors to engage in illicit sexual relations.
Summary/Major Elements:
· Under current law, any person who solicits, procures or knowingly encourages any child under the age of 16 years to engage in illicit sexual penetration or sexual intrusion is guilty of a felony punishable by imprisonment for up to 5 years;
· This bill:
· Amends the elements of the crime of soliciting minors to engage in illicit sexual relations by specifying that an adult who solicits, procures or knowingly encourages any person under the age of 16 years, or a person purported to be under the age of 16, to engage in illicit sexual penetration or sexual intrusion, or who knowingly causes or encourages another person to solicit, procure or encourage such activities, is guilty of a felony punishable by imprisonment for up to 5 years;
· Amends the definition of "child pornography" to include visual depictions of explicit sexual conduct involving a child or an individual virtually indistinguishable from a child, or a visual depiction that has been created, adapted or modified to depict such conduct involving a child or an individual virtually indistinguishable from a child (emphasis added).
