Catch Title: Prison industries program-inmate compensation.
Subject: Amends compensation provisions for inmates participating the prison industries program.
Summary/Major Elements:
· Under current law, the compensation received by inmates participating in the prison industries program is distributed: 10% to the inmate's personal savings account up to $2,500; 5% to the crime victims compensation account unless the inmate does not owe any child support, then the amount is 20%; 30% to pay for the inmate's room and board; up to 25% for child support obligations; and, the balance to be distributed as provided in W.S. 7-16-205 (for personal necessities, programming, medical care, support of family dependents, court ordered restitution or fines, with the balance paid to the inmate upon parole or final discharge).
· This bill:
· Amends the distribution received by inmates as follows:
· 15% of the gross amount to the inmate's personal savings account, up to $2,500, after which the 15% will be distributed as provided under W.S. 7-16-205;
· 20% of the gross amount to the inmate as provided in W.S. 7-16-205;
· Deduction is made for federal income taxes and Medicare;
· 15% of the remaining amount to the crime victims compensation account;
· If the inmate owes child support, the remaining amount shall be paid to satisfy the child support obligation;
· If the inmate does not owe child support, or if there are remaining funds after payment of the child support obligation, those remaining funds shall be used to reduce the cost of room and board for the inmate.
· Requires the Department of Corrections to provide inmates employed in the prison industries program with the forms necessary to comply with child support hearing requirements or court orders.
