Summary/Major Elements:

 

·        This bill:

 

·        Creates the crime of voyeurism;

 

·        Provides a person is guilty of the misdemeanor crime of voyeurism punishable by imprisonment for not more than 6 months, a fine of not more than $750.00, or both, if he, without the consent of the person being viewed, looks in a clandestine, surreptitious, prying or secretive nature into an enclosed area where the person being viewed has an expectation of privacy;

 

·        Provides a person is guilty of a felony punishable by imprisonment for not more than 2 years, a fine of not more than $5,000.00, or both, if he knowingly or  intentionally captures an image with a camera, video camera or other image recording device while committing the crime of voyeurism, or uses a camera, video camera or other image recording device for the purpose of observing, viewing, photographing, filming or videotaping another person under the clothing being worn by the other person if the other person has not consented to the activity.
