Catch Title: Judicial retirement.

Subject: Clarification of applicability of the two judicial retirement systems.

Summary/Major Elements:

· This bill clarifies that:

· Judges appointed prior to July 1, 1998 and those who are currently receiving retirement benefits under Title 5 of the Wyoming Statutes are subject to the judicial retirement system created under Title 5;

· Judges and justices appointed on or after July 1, 1998, are subject to the retirement system created under Title 9 of the Wyoming Statutes.

Comments:

· In 1998, the Legislature created a new retirement system for judges and justices. The existing language in W.S. 5-1-106 was confusing to potential applicants for judicial vacancies because some applicants did not understand which judicial retirement system would apply to them.
