Catch Title:       Developmental disabilities-emergency services.

Subject:  Provides for emergency home and community based waiver services.

Summary/Major Elements:  This act:

· Requires the Department of Health to promulgate rules for determination of emergency cases under the home and community based waiver programs for persons with a developmental disability or acquired brain injury;

· Establishes an emergency contingency account and authorizes the department to expend funds from the account to provide emergency services to the above persons until the emergency is resolved or eligibility for regular services can be determined;

· Appropriates $150,000 from the budget reserve account to the department of health for purposes of this act.  Funds cannot be expended until rules are adopted by the department.

Comments:

· Report required from the Development Disabilities Division of the Department of Health to the Joint Labor, Health and Social Services  and Joint Appropriations Interim Committees by October 1 of each year regarding expenditures from the emergency contingency account and the number of persons provided emergency services.
